Couch White Obtains Approval for Construction of Transmission Line for NY’s First Off Shore Wind Farm

Couch White partner Len Singer was successful in persuading the New York Appellate Division, Second Department to deny a motion for a stay of construction of the transmission line connecting the South Fork wind farm, New York’s first offshore wind farm, to the electric transmission grid in East Hampton, New York. Mr. Singer represented the wind farm developer throughout proceedings before the New York Public Service Commission and in March 2021 obtained authorization for the transmission line to be built.  In August 2021, he defeated a motion for rehearing before the Commission in August 2021 and in November 2021 obtained Commission approval of the Environmental Management and Construction Plan for the project.  Opponents of the project then sought to stay construction during the pendency of an appeal of the Commission’s decision authorizing the project. However, on January 26, 2022, based on the filings by Mr. Singer in opposition to the motion for a stay, the appellate court denied the request for a stay of construction. On January 31, 2022, the Commission issued the developer a notice to proceed with construction of the project and construction of the transmission line started on February 1, 2022.
