Couch White Partners Obtain Dismissal of Lawsuit Challenging the LIPA Decision to Enter into a PPA with SFW

Couch White partner Len Singer recently obtained dismissal of a lawsuit challenging the Long Island Power Authority’s (LIPA) decision to enter into a Power Purchase Agreement (PPA) with South Fork Wind, LLC (SFW) for the purchase of the output from SFW’s 130 MW offshore wind facility. The generation facility is New York’s first offshore wind facility.  The PPA was first entered into in 2017.  The lawsuit, brought in New York State Supreme Court, Suffolk County by opponents of the project was dismissed on the grounds that the action was barred by the applicable statute of limitations and that the challengers did not have standing to challenge LIPA’s decision to enter into the PPA. The transmission line interconnecting the offshore wind facility, to the electric grid in East Hampton, NY, the New York State permits for which were successfully obtained by Mr. Singer, is currently under construction.
