The New York Court of Appeals recently accepted an amicus brief authored by Couch White attorney Alita Giuda, with the assistance of Adam Schultz. The Amicus Brief was prepared on behalf of New York Construction Materials Association, and was submitted in support of Sand Land Corporation and Wainscott Sand and Gravel Corp.’s effort to constitutionally protect its right to use its property for mining purposes according to the mining permit issued by the New York State Department of Environmental Conservation. The matter is expected to be heard by the court in late 2022 or early 2023.
