Couch White litigation attorneys have extensive trial and appellate experience in state and federal court. We regularly appear at jury and non-jury trials, administrative proceedings, arbitration hearings and in appellate courts on behalf of clients in a variety of industries, including banking and finance, construction, energy, engineering and architectural services, government contracting, manufacturing, real estate development, retail and transportation.
Our trial court practice is active in state courts throughout New York as well as its four federal district courts. We also have appeared regularly in Massachusetts and Connecticut state courts. Our appellate practice likewise is active in the New York Court of Appeals and the four intermediate Appellate Divisions, as well as the United States Court of Appeals for the Second Circuit and, as appropriate, the District of Columbia.
Significant state appellate precedents include “restitution” and “rebate” benefits for “Power for Jobs” manufacturers, a declaratory ruling that prevailing wage requirements do not apply to Charter Schools and a series of rulings on the rights and responsibilities of licensed real estate brokers. Our significant federal appellate precedents include decisions upholding employer defenses to union strikes and protective measures (permanent replacements and temporary subcontracting), employer defenses to alleged “reasonable accommodation” claims in disability cases (“light duty” and “leaves of absence”) and commercial free speech rights of state licensees.
