Couch White obtains favorable decision that should expand the viability of On-site Distributed Generation in New York City

In November 2011, Couch White, LLP Managing Partner, Robert M. Loughney, and Associate, Adam T. Conway, from the Firm’s Energy law practice group obtained a very favorable decision from the NY Public Service Commission (“PSC”) that should expand the viability of environmentally-friendly on-site distributed generation (“DG”) projects throughout New York City.

 

The proceeding involved Con Edison’s attempt to limit how large-scale DG projects serving multiple buildings connect to its distribution system, as well as an attempt to impose unwarranted financial penalties on existing DG projects.

 

Among other things, the decision requires Con Edison to develop new tariff language that will expand interconnection options for large-scale DG projects capable of serving multiple buildings.  The ruling also rejected Con Edison’s attempt to change the way certain standby charge penalties are calculated at existing, large-scale DG facilities. Therefore, the ruling represents a crucial victory for proponents of distributed generation and it should expand the viability of this environmentally-friendly technology throughout New York City.
