Mr. Wallender is a member of the Firm’s Corporate, Litigation, Labor & Employment, Environmental, Commercial, Construction, Government Contracts and Real Estate practice groups.
Mr. Wallender specializes in the development and implementation of focused business strategies. He has extensive experience in a broad range of counseling and litigation services involving corporate governance, labor and employment disputes and environmental concerns, as well as antitrust, commercial and regulatory matters. Issues involving corporate operations and transition, control and takeover challenges, minority shareholder disputes and derivative actions, and fiduciary duty and regulatory compliance are addressed and resolved through planning and initiatives designed to accomplish client objectives.
Mr. Wallender has an active litigation and appellate practice involving precedent setting cases in the New York State Court of Appeals, as well as the federal Second Circuit and District of Columbia Courts of Appeals. Innovative litigation and seasoned negotiation strategies are utilized to effectuate practical business resolutions. For example, Mr. Wallender serves as a management negotiator with labor unions regarding project labor agreements and ongoing collective bargaining relationships. Episodic labor disputes are resolved through negotiations, arbitration or unfair labor practice proceedings. ULP charges and employment claims similarly are resolved by negotiation or litigation, including NLRB, EEOC, DOL, State Division of Human Rights and/or judicial forums.
Environmental projects typically involve planning, permitting, compliance, environmental impact statement and/or real estate/land use issues. Negotiated resolutions include permit modifications, consent orders, host community benefit agreements and beneficial use determinations, whereas litigation has been necessary to successfully site controversial projects, including pipelines or landfills.
Mr. Wallender is General Counsel to the New York State Association of REALTORS, Inc.; New York State Commercial Association of REALTORS, Inc.; Commercial & Industrial Real Estate Brokers, Inc.; Capital Region Multiple Listing Service, Inc. and Greater Capital Association of REALTORS. He represents real estate brokers in licensee disciplinary hearings and litigation matters and regularly provides continuing education seminars on real estate regulatory matters.
