Mr. King is a member of the Firm’s Energy and Environmental practice groups. Jim has extensive experience representing varied interests in the energy and environmental fields. His practice focuses on representing corporations in all phases of contractual negotiations, environmental permitting, and regulatory matters.
Through his representation of the Connecticut Industrial Energy Consumers, an ad hoc coalition of industrial end-users located throughout the State, and Multiple Intervenors, an unincorporated association of industrial, commercial, and institutional customers in New York, Jim participates actively in generic and utility-specific rate and restructuring proceedings before the DPUC and the NYPSC. He also has been engaged in representing the interests of consumers at the New York Independent System Operator and ISO-NE.
Jim also has represented large global corporations in the negotiation and preparation of purchase and sale agreements, operating agreements, leases, notes, financings, supply and transportation agreements, and contracts for differences. For example, he has represented clients in:
(i) negotiation of energy and natural gas supply and delivery agreements;
(ii) aggregated customer load for the purpose of securing favorable energy supply pricing;
(iii) procurement of economic development grants and loans;
(iv) negotiation of Direct Customer Operating Agreements at the NYISO;
(v) environmental compliance;
(vi) negotiations with federal, state, and local agencies; and
(vii) negotiation of special contracts with traditional utilities.
In addition, Jim has assisted customers in the development and operation of distributed generation units, natural gas bypasses, and construction of base-load generating units.
He has been involved in a wide variety of environmental permitting proceedings before the New York State Board on Generation Siting and the Environment, the United States Environmental Protection Agency, New York State Department of Environmental Conservation, United States Army Corps of Engineers and the Federal Aviation Administration. In addition, he has permitted both a natural gas and electric transmission line under Article VII of the Public Service Law.
Jim has also represented small natural gas utilities in:
(i) preparation of utility tariffs;
(ii) development of notes;
(iii) environmental compliance;
(iv) negotiations with federal, state, and local agencies
(v) reparation and analysis of contracts.
Prior to joining Couch White, Jim worked with a national law enforcement organization where he contributed to six amicus curiae briefs to the United States Supreme Court.
